AeA Midwest Legislative Update:

2007 has proven to be an active year from a state legislative perspective in the Midwest, particularly in Illinois. The Illinois General Assembly failed to adopt an FY 08 budget effective July 1, 2007, and is now in overtime session. AeA has been directly engaged on a variety of bills in Illinois, most of which directly impact the high-tech industry. This week we provided our State Policy Committee members our regular legislative update on AeA activities and legislation specific to the Midwest region. If you are interested in receiving these reports and/or engaging directly with our committee efforts, please contact me directly for more details. We will continue to be on the ground in Springfield each and every legislative day this summer until the legislature adjourns and appreciate your ongoing support.

AeA Education Foundation:

As members of the high-tech industry, you know that an educated workforce is essential to your success. Today, unfortunately, students aren’t looking at the lucrative opportunities in the technology industry and are seeking other areas when it comes to their education and career paths.

Studies have shown that test scores in math and science have dropped significantly at the high school level and AeA wants to be pro-active in changing this trend. In addition to AeA’s initiatives at the national level to make competitiveness in the science and math industries a key component of legislation in the coming years, we also work outside of the legislative arena primarily through the AeA Education Foundation to fuel these efforts. The AeA Education Foundation was created nearly ten years ago as a vehicle to deliver funds and support solely focused on improving technology education and the development of IT talent.

In addition, the AeA Midwest Council has created the Science, Technology, Engineering and Math (STEM) Scholarship  to assist graduating high school students and continuing college students in reaching their education and career goals in those areas.

We hope you, as valued members of AeA and the technology industry, will help us create greater U.S. workforce strength in the field of technology by supporting our efforts in these areas. You can do this by participating in our June 15th 2nd Annual Golf Outing in which a portion of the proceeds will go directly to the Education Foundation or by sponsoring a student through our STEM Scholarship program.

AeA Reports on Trade with China and Their 15 Year Science and Technology Plan

AeA is pleased to provide you two reports from our ongoing Competitiveness Series:

In anticipation of the second Strategic Economic Dialogue between China and the United States, these reports highlight the opportunities and challenges posed by a rapidly growing China.  On one-hand, China plays an increasingly vital role in U.S. economic growth and helps American companies remain globally competitive.  On the other hand, Chinese efforts to become a world leader in technological innovation could be driving policies that favor Chinese businesses at the expense of foreign enterprises.  AeA is working with its member companies to take advantage of the opportunities, while supporting U.S. policies to deal effectively with the challenges.

China and the United States – The Links Grow Stronger highlights the economic and trade linkages between the United States and China, including:

  • Between 2000 and 2006, U.S. tech exports to China tripled, from $4.6 billion to $14.1 billion.
  • Only the United States’ two NAFTA partners, Canada and Mexico, are larger export destinations for American tech products than China.
  • China needs to act fairly and responsibly in its trade policies, including fair exchange rate policies, respect for intellectual property rights, complete WTO compliance, and other factors that currently strain the economic relationship between China and the United States.

China's 15 Year Science and Technology Plan discusses China's intent to move the country beyond its current reliance on foreign technology to spawn "indigenous innovation."  The report outlines how they intend to do it and what obstacles could stand in their way.

  • Though every detail of the plan has not been made public, we know it calls for China to boost science, technology, and innovation with the long-term goal of becoming a preeminent global economic and technological power.
  • China plans to raise R&D investment from the current 1.4 percent of its economic output to 2.0 percent by 2010 and 2.5 percent by 2020.
  • China is pouring investment into its universities to create world class education and research centers.  Since 1998, state financing for higher education has more than doubled, reaching $10.4 billion in 2003.

International Environment Compliance Programs in Chicago, Portland and Boston Draw 200+

On April, 23, 25 and 27, AeA held it’s annual “International Environment Compliance Program: Update on WEEE, RoHS, REACH and EuP” in Chicago, Portland and Boston respectively.  The events drew over 200 attendees from various cities around the country.

The speakers provided an update and analysis of European Environmental regulations, such as the Restriction of Hazardous Substances Directive (RoHS) and Waste of Electrical and Electronic Equipment (WEEE) Directive, both of which are currently undergoing a review in preparation for a likely revision in 2008.  As the European Union continues introducing new regulations, our program was expanded to also cover the Registration, Evaluation, and Authorization of Chemicals (REACH) directive and how it will affect the U.S. high-tech industry and specific companies.  The other fairly new and broad directive covered at this conference was the Energy Using Products (EuP) Directive, which establishes a framework for setting eco- design requirements for energy-using products.

Building on AeA’s leadership on “China RoHS,” formally known as the Management Methods for Controlling Pollution by Electronic Information Products, AeA provided a comprehensive overview of the China RoHS labeling and information disclosure requirements, as well as an outline of the next steps, such as Catalogue drafting, certification process and enforcement expectations.  With the RoHS-like regulations being introduced or discussed around the world, our presenters provided an update on the developments in other countries such as Argentina, Australia, and Korea.  The program also reported on the U.S. states that have adopted or introduced similar regulations in recent years.

The speakers once again included Steve Andrews, from the United Kingdom’s Department of Trade and Industry, who provided an update on European environment regulatory developments.  We had two U.S. and two European experts from the law firm of Allen & Overy speaking on the EU environment regulations with a specific focus on RoHS and WEEE directives.  Becky Linder, representing AeA in Beijing, presented on China RoHS and Michaela Muranova, AeA's Director of Environment and International Trade Policy, briefed attendees on global trends.  Industry speakers included representatives from AeA member companies such as Cisco, Hewlett-Packard, Intel, Motorola, Tektronix, and others.

U.S. Senate Immigration Bill and What AeA/High Tech is Doing

The Senate Immigration Reform Act, which you have probably been reading a lot about in the last few days, is a comprehensive approach to refining U.S. immigration policy.  AeA takes no position on the sections of the bill having to do with illegal immigration, but we have a definite interest in the provisions on H-1B visas and green cards.  We are supportive of the Cantwell, Cornyn, Hatch, and Leahy amendment which essentially sets aside 140,000 green cards for employer-sponsored high-skilled laborers that will parallel the self-sponsored merit/point based system. 

This amendment recognizes that the complete abolition of employer sponsorship for visas is contrary to the national interest because it would prevent employers from selecting employees with precise skill sets needed that could not be found at home by Americans and would severely damage U.S. innovation and competitiveness.  Without such an amendment the original act would ask companies to select employees out of a world-wide government pre-approved list instead of being able to independently recruit the best talent on their own.  A high-tech executive was recently quoted equating this to asking the San Antonio Spurs NBA basketball team from selecting its draft choices solely from a government list of players.

Whether within a comprehensive immigration bill or not, the high-tech industry cannot wait to see a change in high skilled visa policy as we are at a critical juncture in terms of the ability of the industry to attract and retain the best and the brightest from around the world.  The problem is particularly acute given the shortage of qualified American workers.  This issue is one of AeA's top public policy priorities for 2007 and the Board of Directors will be in Washington, DC, from June 5-7 lobbying Congress on how the shortage of qualified workers directly affects their businesses' ability to remain competitive in a globalized world.

On May 28, I attended a meeting with the Deputy Chief of Staff to the President along with about a dozen other high-tech lobbyists to discuss the Act.  The White House, which is strongly supportive of the Act, wants various interest groups (including high tech) to support the compromise now because in order for a comprehensive bill to become law it has to pass this year.  There is no way that the Administration and Congress wants to take this on next year due to the "politics" of the issue, being that it is an election year.

There is considerable opposition to the bill, not just in the Senate but also in the House of Representatives and specifically among Republicans because of the notion of a perceived amnesty provision.  This past week, I also met with several Members of the House and one very blunt appraisal of the legislation by a prominent Republican pronounced the bill dead on arrival.   Another senior House Republican said that polling from his state was running 95% against the immigration reform measure.  And both doubted that the Senate would even pass it.

So what is AeA going to be doing?  With the Board lobby visits scheduled for the day before the anticipated Senate vote and by using our grassroots capabilities through our councils by visiting with Members of Congress at their district offices, we will be asking Congress to improve the visa reform provisions along the following lines:

  1. Support the Cantwell, Cornyn, Hatch, and Leahy amendment that keeps the employer-based green card system.
     

  2. Increase the number of green cards to eliminate the current backlog.
     

  3. Increase the cap on H-1B visas to a minimum of 150,000 a year with a market demand provision to allow that cap to be exceeded depending on that demand.
     

  4. Retain the worker exemption for advanced degrees and university employees.

State Issues Affecting Your Bottom Line

60+ AeA Members Lobby California Government Leaders at the Annual Tech Summit

On May 16, AeA hosted over 60 member company representatives in California's State Capitol building for the Annual AeA Sacramento Technology Summit. The over-arching theme of the day was how to keep California competitive. At this event, member companies heard speeches from:

During lunch the group was joined by Assemblymembers Nicole Parra (D-CA 30th), Anna Marie Caballero (D-CA 28th), Paul Krekorian (D-CA 43rd), Anthony Portantino (D-CA 44th), Curren Price (D-CA 51st), Mary Salas (D-CA 79th), and Jose Solorio (D-CA 69th) of the New Democrats (formerly known as the Moderate Democratic Caucus) to discuss the priorities of California's high-tech companies, followed by Selvi Stanislaus, Franchise Tax Board, Executive Director.

In addition to having an opportunity to hear several elected officials speak to the group, attendees were split into small groups and met with individual Legislators to discuss AeA's policy priorities in California. Policy issues discussed include:
