Looking Back as Chairman of the AeA Board of Directors

It has been a great pleasure being the Chairman of AeA this past year and as is our tradition at AeA, I would like to spend a few moments reflecting upon my year as Chairman of the Board.

Usually, the Chairman cites a particular event or events in their year as the Chairman.  I suppose I could cite the AeA trip to China last year.  It opened up my eyes and that of a lot of other CEOs in our membership.

But for me, it is less a single event than an accumulation of events in my several years on the AeA Board of Directors.  And most of those events took place at the June 2005 Board meeting that is held in Washington. 

Beginning five years ago, AeA's President and CEO Bill Archey (bio) and his staff made the Washington board meeting into a very special and productive event.  Specifically, rather than having the Board meet in its policy committees as we do at the other two board meetings, we instead go up to Capitol Hill for the day and actually lobby on specific issues.

The whole experience was eye-opening for me and, quite frankly, gratifying as in that first year the sole topic we lobbied on was China Permanent Normal Trade Relations or PNTR. 

We met with 18 members of the House of which 10 were neutral, six were leaning against, and two were outright against. 

Well, the vote was the next day and of the 18 members we met with, 17 voted with us.  And to prove that there is justice, the one who voted against us lost his reelection.

As I have told Bill many times, until I joined the national board of AeA, I really didn’t fully understand the world of public policy and the crazy things that can happen in Washington, in our state houses, and sometimes in foreign lands and how those things can affect our bottom lines, and usually not in a positive way.

Indeed, if one wants to cite a specific event still related to public policy, it was when Bill and I visited Brussels and officials from the European Commission last December.  And I thought Washington presented problems.  Boy was that eye opening.

It has been an honor and a privilege to have been the AeA Chairman and to have associated with so many thoughtful executives from the high tech industry.  I also want to thank Bill and his staff for their enormous support. 

And finally, I must tell you I have been particularly proud of the fact that AeA issued a paper on competitiveness over eight months ago.  That paper has received enormous attention in the media and particularly in the Congress.  And as one member of the Congress stated, “AeA’s paper was the catalyst for waking up those of us in the political and policy sphere about the issues of competitiveness.  And the AeA paper came out before the topic of competitiveness was in vogue.”

Lastly, I would like to announce that Tom Edman, President and CEO, Applied Films Corporation, has become the new Chairman of the Board of AeA.  Mr. Edman is a friend and I look forward to working with him, the Board, and AeA in the upcoming year.

International Issues Affecting Your Bottom Line

AeA Trip to India Builds Ties and Awareness of Member Issues
During the week of September 25-30, 2005, Rob Mulligan, AeA Senior Vice President International, traveled to New Delhi, Bangalore, and Mumbai where he met with the U.S. Embassy staff, the Ministry of Information Technology, several India trade associations, and representatives of both U.S. and Indian high-tech companies. As part of the AeA India Work Group this trip established relationships with the Manufacturers’ Association for Information Technology (MAIT), the National Association of Software & Service Companies (NASSCOM), the India Semiconductor Association (ISA), the Confederation of Indian Industries (CII), and the Federation of Indian Chambers of Commerce and Industry (FICCI). 

The trip also provided AeA with the opportunity to raise awareness about issues of importance to member companies, such as the problems with visa delays. During discussions with the U.S. Embassy, Mulligan offered several suggestions for speeding up the processing of non-immigrant visas for companies trying to bring employees to the U.S., especially in the Southern India region. Sally Ironfield, Chief of the Nonimmigrant Visa Unit, indicated that several changes to be implemented as of October 1, 2005 would help the processing problem. For example, requirements for an interview deposit and switching to a new computer contractor should reduce fraud and problems with no-shows for appointments.

Mulligan also urged the Ministry of Information Technology and the Indian industry associations to support efforts to include an electronics sectoral agreement in the WTO Doha negotiations that would eliminate tariffs on a broad range of electronics products. While MAIT has come out in support of the sectoral agreement, the Indian government prefers to focus on finalizing a formula for the non-agricultural market access negotiations before considering any sectorals. 

Thanks to a rapidly growing middle class, India will be a critical element in most high-tech industry global strategies. The AeA India Work Group is working to keep members abreast of developments through a bi-weekly news report that will continue to identify ways to engage on issues that impact U.S. companies doing business in India. Federal Issues Affecting Your Bottom Line

Congress Taking Action to Increase H-1B Visas and Green Cards
THE GOOD NEWS: Last week, as part of Senate Budget Reconciliation activity, the Senate Judiciary Committee passed a proposal which will allow for up to 30,000 unused H-1B visas to be recaptured and added on to the current cap of 65,000.

In addition, the Senate committee freed up an additional 90,000 employment-based visas (green cards) per year for the next five years. The provision also states that spouses and minor children would no longer be counted towards the annual cap on green cards. This is a very positive development for the high- tech industry.

The Judiciary Committee also increased the application fees on H-1B visas, L visas, and green cards by $500. This will help Congress raise around $300 million in additional revenue for each of the next five years.

This important proposal was introduced by the Chair of the Judiciary Committee, Arlen Specter (R-PA) and strongly supported by fellow committee members Senators Patrick Leahy (D-VT), and Ted Kennedy (D-MA). Senator Kennedy has been a significant advocate on immigration issues related to high-skilled workers.

The Senate is scheduled to vote on this proposal prior to Thanksgiving. AeA expects opposition to these immigration proposals and will be lobbying key Senators to ensure passage.

THE NOT-SO-GOOD NEWS: There is significant opposition to these changes in the House of Representatives. Key Members of the House do not support the increase in the H-1B limit or the release of the green cards. In the next few weeks, AeA will be calling on executives from member companies to participate in a phone-in lobbying campaign with targeted Senators and Representatives, seeking their support on these provisions.

State Issues Affecting Your Bottom Line

AeA Testifies on E-Waste/E-Recycling Legislation in New York City
AeA's State Government Affairs (AeA/SGA) continues to take action on the New York City Council's E-Waste/E-Recycling bill Intro 643On October 23, 2005, AeA's contract lobbyist, The Public Advocacy Group, provided testimony on behalf of AeA at the council's latest hearing on the bill that would force all electronics manufacturers to implement and pay for a method of collecting and recycling a wide array of the used electronic equipment sold within the five boroughs of the Big Apple. 

Under the E-Recycling Bill, manufacturers would face stiff fines for failing to meet the operative minimum recycling standard, which requires the collection and recycling of:

  • 30% of all covered electronic waste by January 1, 2010
  • 55% of all E-Waste by January 1, 2015 
  • 80% of all E-Waste by January 1, 2018

Fines for failing to meet the minimum standard would be between $5,000 and $10,000 for the first offense, $10,000 and $20,000 for the second offense, and $20,000 and $30,000 for the third and subsequent offenses.

More troubling, beginning January 1, 2009, any manufacturer found not to be in compliance with the standard may be prohibited from selling any and all of the program’s covered electronic equipment in the City of New York.

AeA's New York office, through AeA/SGA, has hired a contract lobbyist to follow this issue as our first step in neutralizing this initiative. We have also begun a two-fold education effort in both the New York City Council and Mayor Bloomberg's office to help promote current industry initiatives to increase the recycling of e-waste, as well as current efforts already in place in New York City.

AeA continues to look for member companies to help support our advocacy strategy and assist in educating Council members on the shortcomings of the bill.  Currently 21 of the 51 Council members support the bill, which is only five votes shy of the necessary majority approval.

High-Tech Venture Capital:  1998 -2004

Venture capital investments in the high-tech industry rose in 2004 by 10 percent to $11.8 billion. High-tech venture capital peaked in 2000 at $67 billion and, after falling for three years in a row, is beginning to grow again.

Jill Beasley
Vice President,
Information Technology

Jill Beasley is Vice President Information Technology for AeA where she oversees AeA’s IT infrastructure, training, technology planning, AeANET, and web content. She joined AeA in February of 1990 and is based in Santa Clara, CA.

The rush to procure new security technologies after 9/11 prompted her to lead the design and development of the AeA Online Member Directory. AeA members, the public, and government procurement officials utilize this directory extensively as a key market research tool for sourcing technology products and services.

A notorious "soccer mom," Jill can be found on the sidelines cheering her four kids on at soccer, baseball, and basketball games. She also supports the Breast Cancer 3-Day Walk, advocates for adoption, stays active with her church, and reads voraciously.
