Relevant Experience:
Jean-Philippe Brisson is a Senior Counsel in Allen & Overy's Global Environmental Law Group. JP advises global high-tech companies on all aspects of environmental law, including compliance with newly adopted European Union substance control and take-back requirements. Since 2001, JP has spoken on WEEE and RoHS issues at more than 25 industry conferences organized by AeA, iNEMI, NEDA, SEMI, CMP and other trade associations. JP also has extensive experience advising companies on environmental risks in corporate transactions and international environmental law more generally. JP is uniquely positioned to advise clients on international issues, having worked in the US, Canada and Belgium and having completed law degrees in common law, civil law and international environmental law. Prior to joining Allen & Overy, JP worked at the World Bank, where he advised on the establishment of the Prototype Carbon Fund, one of the world's largest sources of financing for climate change projects.
Representative Engagements:
- Various U.S. and multi-national computer equipment and other high-tech OEMs, EMSs, component manufacturers and distributors—ongoing advice to more than 25 clients regarding compliance with EU environmental directives, including the WEEE and RoHS Directives and the REACH proposal
- US EMSs and OEMs—advised on and designed RoHS compliance strategy, including full product review, assessment of applicable exemptions preparation of materials declaration, review purchase and sales contracts, and prepare letters to
suppliers
- US EMSs and OEMs—advised on and designed WEEE compliance strategy, including advice on liabilities for waste management, negotiation with sales channels partners, contract review, accounting issues, disclosure issues, registration with various Member States
- US OEM—prepared comments submitted to EU Commission in connection with exemptions under the RoHS Directive
- US OEM—prepared comments submitted to a Member State in connection with proposed RoHS rulemaking
- AeA—partnered with AeA to publish guide summarizing new EU requirements applicable to high-tech industry, and to conduct seminars for AeA members
- Major auto manufacturer—advised one of the "Big Three" U.S. automobile manufacturers on end-of-life vehicle regulations in Europe
- World Bank carbon funds—advised on the structure of greenhouse gas emission reduction purchase agreements, prepared participation agreements for new carbon fund and represented the World Bank in its negotiation with a major North American electric utility regarding the utility's participation in a carbon fund.
