know CAN hurt you! at EADS
North America Test & Services, Irvine, CA. This breakfast
program will address how common documents, including, employment-related
documents, have the potential to come back to haunt you, and what steps
you can take today to avoid tomorrow’s headaches. We will present some
key challenges and approaches to this issue and offer tips on how you
can avoid simple errors that can lead to costly lawsuits.

This program is designed for senior level managers and HR personnel
who need:
- Effective strategies for identifying
and addressing legal risks created by your company’s documentation
process.
- Employee policies to ensure your staff
understands corporate email is not entitled to privacy protection.
- Legal recommendations on how to win
litigation if these methods fail.
Topics to be discussed, led by Bruce May,
Partner at Stradling, Yocca, Carlson, & Rauth and Dale Hudson, Counsel
at Nixon Peabody, include the following:
- What dangerous documents exist in your
company’s files?
- Which documents are the most trouble?
How can you avoid turning your company’s documents into dangerous
documents?
- What tools can you provide your
managers to help them comply with legal do’s and don’ts?
- How emails have become a company’s
nightmare and a lawyer’s dream. What can your company do to minimize
legal risks created by emails? With email and other computer-generated
records among the most dangerous of company records, we will examine
best practices for handling these. While often written hastily as a
substitute for a telephone
call, recent legal developments have shown that email can be used in
litigation in ways and with interpretations never intended by the
author.
Stradling
Yocca Carlson & Rauth Partner Bruce May, specializes in labor and
employment law and litigation on behalf of management. His
practice focuses on both preventive counseling on day-to-day personnel
issues and litigation of disputed employees claims.
Areas of specialization include wrongful
discharge counseling and litigation; sexual harassment and equal
employment issues; employment contracts; commission and compensation
plans; drafting and implementing employee handbooks and personnel
policies; family leave, pregnancy, workers compensation and other leaves
of absence; wage and hour; safety and health; trade secrets and post
employment competition; union campaigns; unfair labor practices;
collective bargaining agreements; arbitration; strikes, picketing, and
secondary boycotts; arbitration; and all other areas of personnel
administration.
Mr. May has authored and co-authored
numerous articles in Personnel Journal, The California Labor &
Employment Law Quarterly and others. He has co-authored The Employee
Termination Handbook (J. Allen, Ed.), 1986, John Wiley & Sons, NY.
Published cases include: Todd Shipyards v. City of Los Angeles, (1982)
130 Cal. App. 3d 222, Santos v. Todd Shipyards, 585 F. Supp. (C.D. Cal.
1984) and Todd Shipyards Corporation, 81 L.A. 1095 (E. Jones, Arb.)
Nixon
Peabody Council Dale Hudson has litigated wrong termination,
discrimination, sexual harassment, unfair competition and class action
wage and hour litigation.
He has represented employers before state
and federal courts, administrative agencies at the state and federal
levels, and various arbitration tribunals. Mr. Hudson is also
experienced in the areas of professional liability and business
litigation.
A frequent writer on employment law
topics, he authored the chapter on employment law in The Health Care
Liability Deskbook (1998), published by West Group. Mr. Hudson also
wrote a monthly column on employment law for the Orange Appeal (a
publication of the Orange County Association of Legal Administrators).
